When a family member loses their life as a result of the negligence of another, the family suffers a tragic and unexpected loss. Surviving family members are entitled to claim for various damages pursuant to the Family Law Act of Ontario. The Act permits a spouse (married, common law or same sex), children, grandchildren, parents, grandparents, brothers and sisters of the deceased to recover damages for the expenses they incur, including funeral and travel expenses, loss of income, an allowance for any nursing, housekeeping or other services provided for the person prior to death, and an amount to compensate for the loss of guidance, care and companionship that would have been rendered by the deceased had the death had not occurred.
